Real Estate Agents Will Provide Service with Certificates

Recently, Beijing Municipal Commission of Housing and Urban-Rural Development and Beijing Industrial and Commercial Bureau have enacted three new regulations in succession to standardize the management of real estate agency sector. The new regulations stipulate that those who engage in the work of collecting and spreading information in the trade of real estate, checking the real estates, assisting in the registration process of real estates’ property rights (copy), trading and checking residential houses and working as the agents shall need ‘Registered Certificate of Real Estate Agents in Beijing’ to go to posts from July 1st.

The Commission and Beijing Industrial and Commercial Bureau have enacted three new regulations in succession, including the Qualifications Registration Management Methods of Beijing Real Estate Agents, the Notice on Strengthening the Recording Management of Beijing Real Estate Agents and the Complaint Handling Management of the Misconduct and Illegal Activities of Real Estate Agents and Personnel in Beijing. The three regulations have covered the whole process of the real estate agents’ activities, involving the admittance of real estate agents, standardization of their activities and government supervision.


The official from the Commission introduced that since Beijing started to implement the system of qualifications certificate in 1996, there have been 2322 real estate agents who have received the ‘Certificate of Real Estate Agents in Beijing’ registered in the Beijing Municipal Commission of Housing and Urban-Rural Development (the formal Municipal Administration of State Land, Resources and Housing) by the end of 2008. Besides, 2733 branches and 60 thousand staffs also have been recorded. Real estate agency sector plays an important role in improving the market media, enhancing the trading efficiency and accelerating the circulation of real estate commodities. It is also an indispensable process in real estate market. But there are still many problems, such as the low admittance to real estate agents and institutions having no capacity of undertaking risks and some nonstandard economic activities, etc.

The new regulations require that the personnel, who are going to engage in real estate agency in Beijing, shall get qualifications certificate first or they will not be allowed to engage in such activities. Consequently, if residents need the service of real estate agents, they shall first check the ‘Certificate of Registration’. Each registered personnel can only be hired by one estate agent and engage in activities in the name of that agent rather than the individual participation. The agent also shall not do any part time job in other agents. The certificate will be given after passing the examination and further training. After 3 years, the agent shall register again and have another training at least.

The new regulations also enhance the admittance for real estate agents. Apart from the requirements of having at least 4 personnel in an estate agent, the new regulations have added that there shall be at least 1 national estate agent. Meanwhile, the regulations of the agent (Legal Representatives or Managers) and the head of branch shall get the ‘Registered Certificate of Real Estate Agents in Beijing’.

The Complaint Handling Management of the Misconduct and Illegal Activities of Real Estate Agents and Personnel in Beijing, which aims to strictly standardize the activities of real estate agents, clearly stipulates the actions to be done when real estate agents and personnel violate the principles. Housing, industrial and commercial administrative authorities will fulfill their obligations to supervise and strengthen the investigation and punishment of misconduct and illegal activities of real estate agents. The new Notice of Complaint Handling Management will investigate the suspected illegal activities, with the clues given by the mass.
