Notification of Beijing Municipal Commission of Housing and Urban-rural Development, Beijing Municipal Commission of Development and Reform and Beijing Municipal Human Resources and Social Security Bureau on Further Strengthening the Management of Bid Evaluation Expert of Construction Works in Beijing

Commissions of housing and urban-rural development in all districts, Dongcheng District Commission of Housing and Urban Development, Xicheng District Commission of Housing and Urban Development, Construction Bureau of Economic and Technological Development Zone, development and reforms commissions in all districts, human resources and social security bureaus in all districts and all units concerned:

To enhance the management of bid evaluation expert of construction works in Beijing and earnestly solve the problems found during the current expert management works, and in accordance with the Law of the People's Republic of China on Tenders and Bids, the Implementing Regulations for Law of the People’s Republic of China on Tenders and Bids, the Interim Procedures on Management of Bid Evaluation Expert and Bid Evaluation Expert Database and other relevant laws and regulations, and based on the practical situation of Beijing, it is hereby notified as follows concerning further strengthening the management of  bid evaluation expert of construction works in Beijing:

I. Enhance bid evaluation expert database management and impose strict restrictions on bid evaluation expert access system

(I) The collection of bid evaluation expert candidates shall be carried out through voluntary declaration and employer recommendation. The employer shall be responsible for managing the bid evaluation expert recommended by it.

(II) When making the application, the bid evaluation expert candidate shall not exceed 65 years old, shall be in good health and capable of undertaking the bid evaluation work.

(III) The relevant employer shall check and confirm in writing the authenticity and accuracy of the declaration materials of the bid evaluation expert candidate. Where falsification in the declaration is found and confirmed, the relevant candidate will be disqualified for personal declaration and employer recommendation by Beijing Municipal Human Resources and Social Security Bureau, and the relevant circumstance will be recorded in the credit archives of such candidate and his/her employer.

(IV) Where any bid evaluation expert candidate refuses to be subject to the staff’s management when applying for entering into the database, disturbs the work order, and abuse or threat the relevant staff, which causes adverse effects, such candidate's declaration qualification will be revoked by Beijing Municipal Human Resources and Social Security Bureau, and the relevant circumstance will be recorded in the credit archive of such candidate.

II. Establish bid evaluation expert emergency selection mechanism, and perfect functions of Beijing bid evaluation expert database

(V) Beijing Municipal Commission of Housing and Urban-rural Development, Beijing Municipal Commission of Development and Reform and Beijing Municipal Human Resources and Social Security Bureau shall establish bid evaluation expert emergency selection mechanism, and open the pilot bid evaluation expert emergency selection function on Beijing Public Resources Trading Construction Project Platforms.

(VI) Where the bid evaluation could not be normally conducted due to absence or avoidance of the bid evaluation expert, the emergency bid evaluation expert can be selected from Beijing bid evaluation expert database upon application by bidder and confirmation by Beijing Municipal Commission of Housing and Urban-rural Development.

(VII) Where the emergency bid evaluation expert confirms to participate in the emergency bid evaluation, and is late for bid evaluation for at least three times in a year or absent from the emergency bid evaluation for at least one time in a year, such expert’s qualification will be suspended by Beijing Municipal Commission of Housing and Urban-rural Development.

(VIII) As for the bid evaluation of construction project in Beijing which is subject to bidding according to the law, the bid evaluation expert shall be selected on the same day and the bid evaluation shall be conducted on the next day; as for the bid evaluation of important project in Beijing, upon the application by the bidder and confirmation by Beijing Municipal Commission of Housing and Urban-rural Development,  the bid evaluation expert could be selected and the bid evaluation could be conducted on the same day.

(IX) The emergency bid evaluation expert shall have the same rights and obligations with the bid evaluation expert in Beijing bid evaluation expert database. Where any emergency bid evaluation expert could not participate in the emergency bid evaluation due to the change of personal address, work unit or other information, the expert shall immediately inform Beijing bid evaluation expert database management information system to modify the relevant information.

III. Strengthen bid evaluation expert management, and establish expert credit management system

(X) Administrative handling decision made against the bid evaluation expert violating laws and rules shall be published under real name on Beijing Engineering Construction Trade Information web and Beijing Public Resources Trading Service Platform.

Beijing Municipal Commission of Housing and Urban-rural Development shall enhance the bid evaluation expert credit management and any bid evaluation expert who has violated rules and practiced dishonesty once shall be restricted in all aspects.

(XI) Where any bid evaluation expert violates laws and rules, such expert’s employer’s qualification for recommending the bid evaluation expert candidate in the next year will be suspended by Beijing Municipal Human Resources and Social Security Bureau.

(XII) In case the personal information of any bid evaluation expert is changed, the relevant information in Beijing bid evaluation expert database management information system shall be modified within 30 days from the date of change.

(XIII) In case the employer of any bid evaluation expert is changed, the original employer shall transfer such bid evaluation expert’s information in time and send a notice to Beijing Municipal Human Resources and Social Security Bureau; where, upon the alteration, the expert’s employer does not allow the expert to continue to hold his/her post as a bid evaluation expert, such expert’s qualification shall be suspended by Beijing Municipal Human Resources and Social Security Bureau.

(XIV) Where any bid evaluation expert practices fraud when providing his/her personal information, fails to change or modify his/her personal information, or willfully obstruct the investigation and inquiry by the management authority, the bid evaluation expert will be deemed as violating other laws and disciplines under Article 20(7) of the Rules on Expert Management of Beijing Bid Evaluation Expert Database (JRSZJF (2011) No. 246).

IV. Enhance the establishment of bid evaluation expert team, and establish long-term mechanism for training and check

(XV) Electronic tendering and bidding shall be fully implemented for the construction works in Beijing, and long-distance and nonlocal bid evaluation within the administrative region will be explored and implemented on trial step by step. The bid evaluation expert shall receive electronic bid evaluation training and may participate in the bid evaluation of electronic project tendering after possessing the capacity for electronic bid evaluation.

(XVI) The bid evaluation expert shall reinforce the learning of policies and regulations concerning tendering and bidding; where any bid evaluation expert fails to pass the comprehensive ability check for bid evaluation expert of construction works organized by Beijing Municipal Commission of Housing and Urban-rural Development at regular intervals, fails to participate in the check according to the requirements or fails to pass the check, such expert’s qualification will be suspended by Beijing Municipal Commission of Housing and Urban-rural Development, and the check result will be copied to Beijing Municipal Commission of Development and Reform and Beijing Municipal Human Resources and Social Security Bureau.

(XVII) In case of cheating, exam surrogate or other act of lack of credibility by any bid evaluation expert during the bid evaluation expert assessment organized by Beijing Municipal Commission of Housing and Urban-rural Development, such expert’s qualification will be cancelled by Beijing Municipal Human Resources and Social Security Bureau, and such expert’s illegal behavior will be recorded in his/her credit archive.

(XVIII) This Notice shall take effect upon the date when it is issued.
