
Notification on Modifying the Measures for Management of Credit Information of Property Service Enterprise in Beijing and Other Normative Documents

Commissions of housing and urban-rural development (housing management departments) in all districts, Dongcheng District Commission of Housing and Urban Development, Xicheng District Commission of Housing and Urban Development, Construction Bureau of Economic and Technological Development Zone, and all units concerned:
According to the Circular on Printing and Issuance of Main Points on Promoting Reform Works of Streamline Administration and Institute Decentralization, Power Delegation and Regulation Strengthening Service in 2016 Beijing Municipal Commission of Housing and Urban-rural Development modifies the administrative functions of Beijing Property Management Association under the Measures for Management of Credit Information of Property Service Enterprise in Beijing and other 3 normative documents and deletes relevant terms as follows:
I. Notification on Standardizing Promotion Qualification Grade Assessment of Property Service Enterprise in Beijing (JJF (2010) No.58)
(I) Delete Article 3(6): “Beijing Municipal Commission of Housing and Urban-rural Development entrusts Beijing Property Management Association to organize and convene the expert review meeting, implement expert review system on enterprise apply for class-A qualification, and take expert’s opinions. ”
(II) Delete Article 4: “Beijing Property Management Association shall establish expert committee for class-A qualification of property management, and the review meeting shall be convened at least quarterly and shall comprise 5-7 experts. Expert review meeting comprises on-site inquiry of the applicant’s principal and project manager, and 1 or 2 project managers of property project for management and residential use shall participate in the inquiry. Expert review meeting shall give advice on legal conditions of the enterprise to apply for class-A qualification."
II. Circular on Printing and Issuance of Measures for Evaluation and Management of Property Management Demonstration Project in Beijing and Evaluation Standards and Grading Rules for Property Management Demonstration Project in Beijing (JJF (2010) No.507)
Delete Article IV: “Entrusted by Beijing Municipal Commission of Housing and Urban-rural Development, Beijing Property Management Association (Beijing Property Management Association) is responsible for the organization and implementation of evaluation of property management demonstration project, and shall establish an evaluation management office.”
III. Circular on Printing and Issuance of Measures for Management of Credit Information of Property Service Enterprise in Beijing (JJF (2010) No.658)
(I) Delete Article 3(4): “Beijing Property Management Association (Beijing Property Management Association) shall formulate and implement the personnel cultivating program for property service industry in Beijing, and organize the continuing education training for project leader; Beijing Property Management Association may formulate and issue the credit rating criteria of property service enterprise, form a credit assessment system of property service enterprise and establish the credit incentive and punishment mechanism of property management industry”.
(II) Delete Article 23: “Beijing Property Management Association may establish the annual credit ranking system of property management industry. Annual credit ranking shall be carried out based on assessment index such as the basic information, performance information and warning information of property management enterprise and project leader, and shall be publicized”.
(III) Delete Article 26: “Beijing Property Management Association may establish the industry dishonesty warning system. As for any enterprise whose score deductions accumulate to more than 20, or any project leader whose employee score accumulate to more than 15, Beijing Property Management Association may include such enterprise or project leader in the list of serious dishonesty, publish such list and report the list to the competent authority”.
(IV) Delete Article 14 of Scoring Standard for Illegal Behaviors of Property Service Enterprise and Project Leader in Beijing: “fails to provide the assessment and supervision organization with any necessary materials truthfully and according to the requirements”.
(V) Modify Article 19(5) as follows “Based on the credit scoring result of property service enterprise and project leader, the enterprise’s legal representative, principal and project leader shall receive the relevant regulations and credit knowledge training from the housing administrative department in charge in Beijing”.
(VI) Modify Article 24(1) as follows: “the credit information can offer the basis for supervision and administration of property service enterprise qualification and grade assessment, property management demonstration project evaluation, property service evaluation and supervision, property management industry expert recruitment and other works conducted by municipal and district housing administrative departments in charge and other relevant competent administrative departments”.
IV. Notification on Further Standardizing Property Service Management Works for Security Housing and Other Housing (JJF (2015) No.8)
(I) Delete Article 2: “Beijing Municipal Commission of Housing and Urban-rural Development (Beijing Municipal Commission of Housing and Urban-rural Development) entrust Beijing Property Management Association (Beijing Property Management Association) to establish the business directory of enterprises undertaking security housing projects based on the qualifications, performance, credit information records, social reflections and other information of property service enterprises, and encourage enterprises with high qualification grade and strong strength to participate in project's property service. Any property service enterprise not included in the business directory shall not undertake the preliminary property service business of any security housing project in Beijing.
1. Property service enterprise included in the business directory of enterprise undertaking security housing project shall meet the following conditions:
(1) Possessing at lease class-II (inclusive) qualification for property service enterprise;
(2) Accumulative area of residential projects filed in Beijing exceeds 200,000 square meters;
(3) The property service enterprise and the project leader have no score-deducting record, and there is no unlawful property service activity 2 years before the application;
(4) The proposed property service project leader has obtained the job certificate for property service project leader in Beijing;
(5) The property service enterprise has a sound internal management rules and regulations;
(6) Other conditions which should be met according to the requirements.
2. In case any of the following circumstances, the property service enterprise shall be included in the bad supervision record, and shall not be included in the business directory of enterprise undertaking security housing project; any enterprise which has already been included in such business directory shall be kicked out of the directory.
(1) Common parts or common facilities in the property project have any major safety loophole due to the property service;
(2) The owner makes complaint due to property service problem, and the property service enterprise refuses to make any correction ordered by administrative department;
(3) There is any illegal construction or illegal group-renting during the property service, or after accepting the commission, the enterprise finds any illegal leasing, lending, change of use of security housing and fails to make a report to the relevant authority in time;
(4) After undertaking the property service business, the enterprise subcontracts the entire property service within the whole or part of project management area to any third party;
(5) The enterprise is confirmed to undertake the property service business of security housing project, but refuses to undertake the business for three times without any cause;
(6) The property service enterprise and the project leader have score-deducting record, and there is any unlawful property service activity conducted by the enterprise;
(7) Conduct any other illegal acts.
3. Where any property service enterprise is not included in or is kicked out of the business directory because it has any bad supervision record, and has no bad supervision record anymore within two years from the date when it is kicked out of the business directory, the enterprise may apply to Beijing Property Management Association for being included in the business directory again. After passing the review, the enterprise can be included in the business directory.”
(II) Delete Article 3: “As for new security housing project (including concentrated construction and commercial housing matched building), where the construction company entrusts the property service enterprise to provide preliminary property service, the recruitment procedure shall be simplified, and the property service enterprise possessing relevant qualifications shall be selected from the business directory through lottery before obtaining the commodity house presale license or before the sale of completed house; the construction company may also directly appoint any class-A property service enterprise in the business directory to conduct the property service.”
(III) Delete Article 4: “where the house-owner convention is established for any security housing project which has been completed and put into service, the property service enterprise can be recruited and selected by owners in the house-owner convention; where the house-owner convention has not been established or has been established but fails to perform its duties, the property service enterprise possessing relevant qualifications shall be recruited and selected from the business directory through lottery by the community neighborhood committee or Subdistrict office (people's government of township) at the place where the project is located. ”
(IV) Delete Article 5: “As for any concentrated construction public rental housing project, the property unit can organize the residents to conduct self-management or self-service, and can appoint the property service enterprise to conduct property service. Where the property unit entrusts the property service enterprise to conduct property service, the property unit shall recruit and select the property service enterprise according to Article 3 hereof before public distribution.”
(V) Delete Article 6: “Where the property service enterprise is to be recruited and selected through lottery for security housing project, the following organization and implementation program shall apply.
1. Before recruitment of property service enterprise, the employer shall issue the recruitment notice on the website of Beijing Property Management Association and specify the basic information of project and the recruitment conditions. The application period shall not be less than 15 days.
2. After the property service enterprises in the business directory file the written application to the employer within the application period specified in the notice, and determine their project leaders, and pass the examination by the employer according to this method, the employer shall determine the property service enterprise winning the lot through lottery.
3. Where no eligible property service enterprise files application within the specified period, the employer may directly select 5 property service enterprises with relevant qualifications from the business directory. The employer shall discuss matters concerning the undertaking of property service with the enterprises winning the lot based on the lottery order; where any enterprise waives its right of undertaking, the next enterprises shall fill the vacancy in order of precedence until the property service enterprise undertaking the service is finally determined.
4. Unified lottery software in Beijing shall be used for lottery. The lottery and recruitment result shall be published on the websites of Beijing Municipal Commission of Housing and Urban-rural Development and Beijing Property Management Association.
The entire lottery process shall be videoed by the employer, and the employer shall invite the owners' representative and lessees' representative and the public to supervise the lottery on site, and shall receive supervision from the county housing administrative department, housing security authority and Subdistrict office (people’s government of township) at the place where the project is located and Beijing Property Management Association.
(VI) Delete Article 7: "In principle, the number of new property service business of security housing project undertaken by the property service enterprise within a year (from January 1 to December 31) shall not exceed 5 for class-A property service enterprise and 3 for class-B property service enterprise."
(VII) Delete Article 19: “Beijing Property Management Association shall formulate the business directory of property service enterprises undertaking security housing project and conduct the relevant service works, and shall not collect any charges.”
The recruitment of security housing service enterprise shall be subject to the relevant property management regulations of Beijing.
This Notice shall be implemented from the day of issuance.
It is hereby notified.
